Scope & Statement of Intent
This Acceptable Use & Anti-Spam Policy ("AUP") sets forth the obligatory rules of conduct governing all access to and interaction with the Solanacy Websoft Suite, including billing terminals, cloud ERP systems, customer e-commerce storefronts, and automated messaging endpoints developed and operated by Solanacy Technologies (Howrah, West Bengal, India).
Solanacy provides mission-critical digital infrastructure for legitimate business operations. Any utilization of our software to harass consumers, spam WhatsApp users, process illicit transactions, or compromise digital infrastructure is strictly prohibited and constitutes grounds for immediate termination without refund.
Meta WhatsApp Cloud API Compliance
Solanacy Websoft includes an integrated WhatsApp notification engine powered by the official Meta WhatsApp Cloud API. All merchants utilizing this messaging capability must strictly adhere to the following binding parameters:
- Prohibition of Cold Broadcasts: Merchants shall not upload scraped, purchased, or third-party phone lists to blast unsolicited promotional marketing or bulk offers.
- Frequency Capping: Merchants must avoid transmitting repetitive messages to the same customer within a short duration, except where required for live delivery status.
Customer Opt-In & Mandatory STOP Rules
In compliance with the Digital Personal Data Protection (DPDP) Act 2023 and the Telecom Commercial Communications Customer Preference Regulations (TCCCPR / TRAI):
- Prior Explicit Consent: The Merchant warrants that customer phone numbers entered at the checkout counter or online checkout are provided voluntarily with consent to receive digital transaction receipts.

Instant STOP Unsubscribe: Every automated WhatsApp invoice generated by Websoft concludes with the explicit message: "Reply STOP to opt-out of automated receipts." When an end-customer replies with
STOP,UNSUBSCRIBE, orCANCEL, the Websoft engine automatically blacklists that mobile number from further automated messages. Merchants are strictly forbidden from attempting to bypass or clear this block manually.
Prohibited Commercial Goods & Operations
Solanacy Websoft Suite shall not be deployed, configured, or utilized in connection with any of the following commercial categories:

System Abuse, Security Testing & Hacking
Clients, operators, and unauthorized third parties are strictly prohibited from compromising the technical integrity of Solanacy infrastructure:
- No Unauthorized Penetration Testing: Executing automated vulnerability scanners, fuzzers, SQL-injection probes, or port scans against Solanacy production endpoints without prior written authorization from our security team is strictly prohibited.
- No Denial of Service (DoS/DDoS): Transmitting volumetric flood traffic, SYN floods, or malicious API payload stress tests designed to impair system availability.
- No Binary Tampering or Decompilation: Modifying client-side WebAssembly (WASM) cryptographic modules, patching license check routines, or injecting unauthorized JavaScript into shared multi-tenant runtime sandboxes.
Scraping & Data Harvesting Restrictions
All automated scraping, crawling, or systematic data extraction targeting Solanacy Websoft is forbidden:
POS Fraud & Staff Shift Misuse
Solanacy Websoft provides comprehensive internal audit controls. The software must not be manipulated to facilitate tax fraud or employee theft:
- Fictitious Billing & Tax Evasion: Generating fraudulent GST tax invoices without underlying merchandise sales, or manipulating tax percentages to evade GST liabilities, is strictly illegal under the CGST Act 2017.
- Audit Trail Tampering: Attempting to truncate, modify, or erase cashier shift audit logs or cash drawer reconciliation records.
Rate Limits & Fair Use Policy (FUP)
To preserve cloud infrastructure responsiveness for all merchants, the following Fair Use Policy limits apply to standard hosted instances:

Statutory Cyber Liabilities & BNS Penalties
Violations of this Acceptable Use Policy are enforceable under Indian penal and cyber statutes:
- Information Technology Act, 2000 (Section 43 & 66): Penalties for hacking, unauthorized data download, and introduction of computer contaminants.
- Bharatiya Nyaya Sanhita, 2023 (BNS): Prosecution under Section 316 (Criminal Breach of Trust) and Section 318 (Cheating and Dishonestly Inducing Delivery of Property) for fraudulent chargebacks or code misappropriation.
Security Auditing & Continuous Monitoring
Solanacy continuously monitors API telemetry, spam complaint rates, and rate-limit violations:
In the event of an abuse investigation, server audit logs, WhatsApp delivery receipts, and terminal login records constitute admissible electronic evidence under Section 61 and Section 63 of the Bharatiya Sakshya Adhiniyam, 2023 (BSA).
Enforcement Actions & Account Suspension
Upon detection of a material AUP violation, Solanacy reserves the right to take proportionate enforcement action:
- Level 1 — API Throttling & Warning: For minor Fair Use exceedances or elevated WhatsApp opt-out rates, the merchant receives a written alert and temporary messaging throttling.
- Level 2 — Service Suspension: For unresolved spam complaints or suspected cyber attacks, messaging channels or terminal cloud sync will be suspended pending investigation.
- Level 3 — Permanent Account Termination: For illegal drug sales, deliberate fraud, or severe cyberattacks, services will be terminated immediately with forfeiture of all fees paid.
